Terms & Conditions

 
  • “Customer” – means a paying guest of Tòmò;

    “Tòmò” – means the Tòmò location to which the reservation applies;

    “Rates” – means the prices payable for rooms and (where applicable) other facilities offered by Tòmò;

    “No Show” – means a guest not arriving at the hotel on the date of arrival of their reservation without prior notice to Tòmò.

  • Customers may make reservations in advance through Tòmò website.

    Customers are required to provide identification (passport or driver’s license) and information including, but not limited to, their name, address, contact telephone number, nationality and email address. In case no authorised credit card can be presented, Tòmò withholds the right to deny entrance to the hotel. 

    Your reservation shall be paid in full 48 hours prior to arrival latest.

    Reservations booked in advance do not constitute a legally binding contract between Tòmò and the Customer until Tòmò confirms the reservation with the Customer and provides the Customer with a booking reference.

    Reservations may be changed by the Customer at any time prior to arrival (subject to the cancellation provisions set out in Clause 4 below). Tòmò will use all reasonable endeavours to accommodate any changes requested but gives no guarantee that all changes will be accommodated.

    Reservations are not required. Customers may make bookings on arrival however Tòmò cannot guarantee the availability of rooms or other facilities for such bookings.

    Customers may request additional nights at Tòmò at any time during their stay. Tòmò will use all reasonable endeavours to accommodate such requests.

    For reservations for groups of more than 10 persons, special preconditions apply. Customer is required to send an email to the hotel of choice for the request of a group reservation. If separate reservations are made resulting in a group of more than 10 persons, Tòmò holds the right to refuse such a group upon check-in.

  • Details of Rates including, where applicable, promotional Rates and other special offers are available from Tòmò website.

    Rates and prices quoted when making reservations apply only to accommodation unless otherwise stated. Additional charges may apply for items including, but not limited to, meals and drinks. These items are to be paid at check-out.

    Tòmò may offer non-refundable Rates.

    The following provisions apply:

    Advance payments made are non-refundable.

    Any deposits or booking fees taken at the time of reservation are non-refundable.

    The following payment methods are accepted by Tòmò:

    Credit Cards – Visa, Mastercard

    Debit Cards – Maestro, VPay

    We do not accept cash.

  • Reservations may be cancelled without charge provided the Customer gives notice 24 hours before the date of arrival (00:00, local GMT time) of their reservation. Any sums paid in advance to Tòmò shall be refunded to the Customer.

    In the event that the Customer has paid in advance, no refunds shall be made in the event of cancellation.

    Failure to provide the required notice of cancellation 24 hours before the date of arrival shall result in the Customer being charged for one night’s accommodation at the Rate specified in their reservation.

    In case of a No Show the Customer is charged for their full stay. No refund will be provided.

    In case of a No Show the subsequent nights, if any, will be cancelled. So if you are delayed getting to us please inform us and we can try to amend your booking (subject to availability).

    Tòmò may, in an exceptional case, cancel a reservation. In the event of such cancellation, the Customer shall be informed immediately and shall be offered a full refund of any and all sums paid. Where a refund is offered conditions pertaining to advance payments shall not apply and a refund shall be payable.

     

  • Guest can check-in at Tòmò from 3 pm.

    Tòmò offers self check-in. Guest check-in on their smartphone or other terminal. In case assistance is required, guest can contact Tòmò.

    Check-out time at Tòmò is 12pm. Failure to check-out by 12pm may result in the Customer being charged for an additional night’s accommodation at the standard applicable Rate.

  • Customers are required to conduct themselves in a reasonable and responsible manner at all times when staying at Tòmò and must not act in any way which may disturb other guests. Any Customer who, in the opinion of our staff, compromises the comfort, safety or security of other guests, staff or local residents will be asked to leave the hotel premises and will not be given a refund and all sums due shall become immediately payable. 

    Customers shall be charged for any and all damage caused by them to Tòmò property during their stay. A minimum additional cleaning penalty of € 50 will be applied in case of an extremely dirty room.

    Smoking traditional and electronic cigarettes is not permitted in any indoor area of Tòmò. Failure to adhere to these requirements shall result in the Customer being charged for any and all costs incurred by Tòmò in cleaning the room (including, but not limited to, fixtures, fittings and soft furnishings), restoring it to a smoke-free environment and paying off local fire hazard penalties and costs with a minimum of € 700,00 per case. Tòmò is subsequently allowed to ask the guest to leave the premises immediately. A refund will not be issued then.

    No animals are allowed in the rooms.

    Tòmò facilities are not suitable for children under the age of 4 years old. Children under the age of 4 years old may not stay at Tòmò. Children under the age of 16 need to be accompanied by an adult, children under the age of 18 years are required to provide Tòmò parental authorization form prior to check-in.

    Any guest found using drugs within any of the hotels will be asked to leave the premises immediately. A refund will not be issued.

    We do not serve alcohol to anyone under the age of 18.

     

  • Unless expressly indicated otherwise, food and drinks are not included in any Rates and will be charged for.

  • To the fullest extent permissible by law, Tòmò liability for any loss or damage suffered by Customers shall be limited to that which arises out of the negligence of Tòmò employees, subcontractors or agents.

    Tòmò shall not be liable for any indirect loss or damage which may be suffered by a Customer including, but not limited to, loss of income, loss of business, loss of profits, loss of opportunity, loss of anticipated savings, loss of data or loss of enjoyment.

  • Tòmò may, from time to time, change these Terms and Conditions without notice, however it will use its reasonable endeavours to inform Customers as soon as is reasonably possible of any such changes.

  • Tòmò will not share Customers’ personal data with any third parties for any reasons without the prior consent of the Customer concerned.

  • These Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the German law.

    Any dispute, controversy, proceedings or claim between the Parties relating to these Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of Germany.
